1. Introduction

Welcome to bleach.dental (the “Platform”), operated by Pipexe OÜ. The Platform provides AI-powered simulations for dental veneer and smile design visualization (“Simulations”). Simulations are provided for visualization and communication purposes only and do not constitute medical advice, diagnosis, treatment, or guaranteed outcomes.

By creating an account, logging in, or using the Platform, you agree to these Terms and any referenced policies, including our Privacy Policy. If you do not agree, do not use the Platform.

2. Definitions

• “Pipexe OÜ” / “we” / “us”: Pipexe OÜ, Tornimäe tn 5, Kesklinna linnaosa, Tallinn, Harju maakond, Estonia, registry code 17216141.
• “User” / “you”: Any person or entity accessing or using the Platform.
• “Content”: Any data, images, files, text, or other materials uploaded, submitted, or generated on the Platform.
• “User Content”: Content you upload or submit (e.g., photos and related inputs).
• “Simulation”: AI-generated visual previews representing potential cosmetic dental outcomes.
• “Credits”: Usage units provided via subscription, purchase, promotional campaigns, or free allocations.
• “Free Credits”: Promotional or complimentary Credits not paid for by you.
• “Third-Party Providers”: External services supporting the Platform (e.g., hosting, storage, AI model providers, analytics, payment processors).
• “Terms”: These Terms of Use.

3. Acceptance of Terms (Required on Login)

Access to bleach.dental requires affirmative acceptance of these Terms (for example, by clicking “I Agree”) during account creation and/or login (“Clickwrap Acceptance”).

We record acceptance details (including timestamp, user ID, and Terms version). If you do not accept, you cannot access the Platform.

If we update these Terms, you may be required to accept the updated version at your next login before continuing to use the Platform.

4. Description of Services

The Platform generates AI-powered cosmetic dental visualizations intended to support communication between dental professionals/clinics and their clients. The Platform may:

• Produce Simulations from User Content (e.g., photos); and
• Provide outputs that may be viewed, saved, or downloaded depending on your plan.

No Medical Advice. The Platform is not a medical device and does not replace professional dental/medical consultation. Final outcomes depend on clinical evaluation, treatment planning, materials, anatomy, and other factors.

5. Limitations and Restrictions

1. AI and photo limitations: Results depend on input quality (lighting, angle, resolution). Outputs may be inaccurate, incomplete, or visually inconsistent.
2. No guaranteed availability: The Platform is provided on an “as available” basis. Maintenance, outages, changes, or discontinuation may occur.
3. Third-party dependence and quotas: The Platform relies on Third-Party Providers. If those providers impose rate limits, outages, or quota restrictions, Simulations may be delayed, limited, or temporarily unavailable—even if you have Credits.
4. Plan and fair-use limits: Use may be limited by Credits, subscription tiers, and fair-use rules we may apply to prevent abuse.
5. No misuse: You may not misuse the Platform (see Section 8).
6. We may change the service: Features may be modified, added, or removed at any time.

6. User Content and Required Rights

You represent and warrant that:

• You own or have lawful rights to upload any User Content you submit; and
• Where images include a third party (e.g., a patient), you have obtained all necessary consents and permissions required by law and professional standards (including consent to upload, process, and store the images for generating Simulations).

You are responsible for your User Content and how you use Simulations.

No sensitive data unless permitted. You agree not to upload sensitive personal data (including health data) unless you have a lawful basis and required consents to do so.

7. Data Processing and Storage Permissions

By using the Platform, you grant permission for us (and our Third-Party Providers acting on our behalf) to:

• Upload, receive, and process your User Content to generate Simulations;
• Store your User Content and generated Simulations to provide the service (including account continuity, history, viewing, and downloads);
• Transmit and host data using trusted infrastructure and subprocessors (e.g., hosting, storage, AI providers);
• Process account and billing data for authentication, payments, support, and service notifications;
• Collect technical and usage logs for security, fraud prevention, troubleshooting, compliance, and performance improvements.

Privacy Policy controls. Retention, deletion requests, and personal data handling are described in our Privacy Policy.

AI training clarification. We do not use your User Content to train third-party AI models unless explicitly stated in the Privacy Policy or you separately consent (where required by law).

8. Acceptable Use (Prohibited Activities)

You must not:

• Upload Content that is illegal, harmful, infringing, or violates privacy/consent requirements;
• Attempt to reverse engineer, bypass protections, or interfere with the Platform;
• Use automated scraping/bots to extract data or overwhelm the service;
• Share accounts, resell access, or bypass plan/Credit limits without authorization;
• Use Simulations to mislead users/patients, make false claims, or present Simulations as guaranteed outcomes.

9. Payments, Plans, Credits, and Free Credits Ownership

Some features require payment or Credits. Plan details (including pricing and included Credits) are shown on the Platform and may change.

9.1 What you are purchasing. Paid plans provide access to the Platform and allow you to generate High Quality Simulations using Credits during the applicable billing period.

9.2 Subscription billing and renewal. If you purchase a subscription, you authorize us (and our payment processor) to charge the applicable fees on a recurring basis (e.g., monthly) unless you cancel before the renewal date. Subscription fees are charged in advance of each billing period.

9.3 Credits, expiration, and consumption order.
 (a) Credits are usage units required to generate Simulations.
(b) For monthly plans, Credits are valid only for the applicable monthly billing period and expire at the end of that billing period unless expressly stated otherwise (no rollover).
(c) When you generate a Simulation, the Platform will apply Credits closest to expiration first.

9.4 Cancellation and end of access. If you cancel after payment, cancellation takes effect at the end of the then-current paid billing period. You will retain access to the Platform and may use remaining Credits until that billing period ends. After the paid period ends, access will end and your account may be deactivated or terminated.

9.5 Failed payments. If payment is not successfully processed, you will not receive Credits for that billing period and you may not be able to generate Simulations. We may suspend access until payment is resolved.

9.6 Free Credits ownership rule. Simulations generated using Free Credits are owned by Pipexe OÜ (“Free-Credit Simulations”). You retain ownership of the original photos/inputs you upload, subject to the license granted in these Terms.

9.7 Use of Free-Credit Simulations. Pipexe OÜ may store and reuse Free-Credit Simulations for Platform operation, security, quality assurance, and product improvement. We will not publicly use patient-identifiable User Content for marketing without appropriate consent or lawful basis.

9.8 Taxes and refunds. You are responsible for any applicable taxes unless otherwise stated. Fees and Credit purchases are non-refundable except where required by law or explicitly stated in a written offer.

9.9 Provider capacity and quotas. Availability may be affected by Third-Party Provider rate limits or quotas; delays or temporary unavailability do not entitle you to refunds unless required by law.

10. Intellectual Property and Licenses

• Our IP: Pipexe OÜ owns the Platform, software, design, branding, and all related intellectual property.
• Your IP: You retain ownership of your User Content.
• License to Pipexe OÜ: You grant Pipexe OÜ a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, and use your User Content solely to provide, maintain, secure, and improve the Platform and comply with legal obligations.
• Restrictions: You may not copy, resell, distribute, or make derivative works of the Platform or its components except as explicitly permitted by us in writing.

11. Suspension and Termination

We may suspend or terminate your access immediately if:

• You violate these Terms;
• We detect suspicious activity (including fraud, account sharing, automated scraping, abnormal usage patterns, chargebacks indicative of fraud, or attempts to bypass quotas/limits); or
• Required by law or necessary to protect the Platform, users, or third parties.

You may stop using the Platform at any time. Upon termination, your right to access the Platform ends immediately.

12. Disclaimer of Warranties

The Platform and Simulations are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee that Simulations will be error-free, accurate, or available at all times.

13. Limitation of Liability

To the maximum extent permitted by law, Pipexe OÜ will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising from your use of the Platform or Simulations.

If liability cannot be excluded, our total liability for any claim will be limited to the amount you paid to Pipexe OÜ for the Platform in the three (3) months preceding the event giving rise to the claim (or the minimum amount allowed by law, if greater).

14. Indemnification

You agree to defend, indemnify, and hold harmless Pipexe OÜ from claims, damages, liabilities, and expenses arising out of:

• Your User Content (including lack of rights/consent);
• Your use of the Platform; or
• Your violation of these Terms or applicable laws.

15. Force Majeure

Neither party is responsible for delays or failures due to events beyond reasonable control, including Third-Party Provider outages/limitations, internet failures, government actions, and other force majeure events.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of Estonia. Parties will first attempt to resolve disputes through good-faith negotiation. If unresolved, disputes will be submitted to the competent courts in Estonia, unless mandatory consumer protection laws require otherwise.

17. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms (and referenced policies) constitute the entire agreement between you and Pipexe OÜ regarding the Platform.
